• Client delays in providing feedback may impact delivery dates
• Force majeure events may cause reasonable delays
• Change requests may result in additional time and costs
• Final deliverables are provided upon completion of payment

7. Warranty and Support

Our warranty and support terms include:

• We provide a limited warranty on custom development work
• Bug fixes are provided for a specified period post-launch
• Support terms are defined in individual project agreements
• Third-party integrations are supported according to vendor terms
• Ongoing maintenance services are available separately

8. Limitation of Liability

ThoughtPenguin's liability is limited to the maximum extent permitted by law. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses.

9. Confidentiality

Both parties agree to maintain confidentiality of proprietary information shared during the course of the business relationship. This includes but is not limited to business strategies, technical specifications, user data, and financial information.

10. Termination

Either party may terminate services under the following conditions:

• Material breach of contract by either party
• Non-payment of fees after proper notice
• Mutual agreement between both parties
• Completion of project deliverables

11. Force Majeure

Neither party shall be liable for any failure or delay in performance due to circumstances beyond their reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, pandemic, or government regulations.

12. Governing Law

These terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts in India.

13. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting to our website. Continued use of our services after changes constitutes acceptance of the new terms.
